Terms of Service

These Terms of Service ("Terms") govern your use of the MilkNHoney mobile application ("the app"), developed by MilkNHoney ("we", "us"). By downloading, installing, or using the app, you agree to these Terms. If you don't agree, please don't use the app.

This is a working draft covering the app's actual functionality as of this date. It is not a substitute for legal advice from a licensed attorney.

1. What the app does

MilkNHoney lets you scan a product's barcode, QR code, or photograph to get an ingredient-safety score, active FDA recall checks, and price comparisons, plus optional shopping lists and dietary-preference matching. Core scanning and rating features are free. Some features — including AI-powered photo identification of products without a barcode — are offered as an optional premium feature. No payment is currently being collected for premium features; if that changes, these Terms will be updated to describe pricing, billing, and cancellation before any charge is introduced.

The app is available internationally. Where a feature depends on a region-specific data source (e.g. FDA recalls, USDA ingredient data, US-focused retailers), that's noted in-app; regulatory citations and safety data reflect a mix of jurisdictions and aren't limited to any one country.

2. Not medical, legal, or safety advice

The ingredient-safety ratings, flags, severity labels, dietary-restriction/allergen flags, and nutrition-based diet compatibility checks shown in the app are for informational purposes only and are not medical, legal, or professional safety advice. The app is not intended to diagnose, treat, cure, or prevent any disease or condition, and is not a substitute for professional medical advice, a doctor, or a registered dietitian. This includes the dietary-preference features covering diabetes-relevant, keto, low-sodium, low-fat, and high-protein checks: these compare a product's listed ingredients and, where available, its label nutrition facts against generic, publicly cited thresholds (see in-app sourcing) — they are not personalized to your medical history, medications, allergies' severity, or a clinician's guidance, and are not a certified or lab-verified check. Nutrition-based checks that lack real per-serving label data are shown as "uncertain," never guessed; even a "compatible" or "restricted" result can be wrong if the underlying label data is wrong, outdated, or the product's formulation has changed. The underlying ingredient and nutrition databases are a work in progress, may be incomplete, and reflect a mix of official regulatory actions, third-party label data, and independent/consumer research that may be disputed or later revised. Always read the actual product label and consult a qualified professional for medical or dietary decisions, especially regarding allergies, diabetes or other medical conditions, medications, or pregnancy. Never use this app as your sole basis for a medical or dietary-management decision.

3. Accuracy and limitations

Product, ingredient, recall, and pricing data comes from third-party sources (Open Food Facts, USDA FoodData Central, FDA's openFDA, the Kroger API, Open Prices, OpenStreetMap, and others) — see the Privacy Policy for details on what's sent to each. This data may not be complete or fully current: product formulations change, ingredients can vary by region, and barcode/UPC matching can occasionally be wrong. We don't control the accuracy, completeness, or availability of third-party data and aren't responsible for errors in it. Price and store information in particular may be outdated or crowdsourced and should be verified before making a purchasing decision. Recall information is checked live against openFDA but isn't guaranteed to be instantaneous.

Users should independently verify critical product information themselves, especially for allergies, medications, and other health-sensitive decisions.

4. Your account

Creating an account is optional. You're responsible for keeping your login credentials secure and for all activity under your account. You must be at least 13 years old (or the minimum age required in your country to use online services without parental consent) to create an account.

5. Acceptable use

You agree not to: use the app to violate any law; attempt to reverse-engineer, decompile, scrape, bulk-extract data from, or circumvent rate limits on the app or the third-party APIs it calls; submit false or misleading price reports or reviews; or use the app in any way that could disable, overburden, or impair it for other users.

6. Content you submit

If you submit a price report, photo, or other content (e.g. via Open Prices), you're responsible for that content and confirm you have the right to share it. Some submissions are published publicly and permanently by the third-party service they're sent to (see the Privacy Policy) — this cannot be undone once submitted.

7. Third-party services

The app integrates with, among others: Open Food Facts (product/ingredient database), USDA FoodData Central (nutrition data), the Kroger API (product search and pricing), Open Prices (crowdsourced pricing), OpenStreetMap/Nominatim (store location lookup), openFDA (recall data), OCR.space (ingredients-photo text extraction), SerpApi (live retailer price search), Sentry (crash/error monitoring), and optional AI providers (Anthropic). Each service has its own terms and privacy policy; we aren't responsible for their accuracy or availability. The app does not process payments itself and links out to retailers for checkout.

8. No warranty

The app is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, or uninterrupted/error-free operation.

9. Limitation of liability

To the maximum extent permitted by law, MilkNHoney and its developers are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the app, including but not limited to reliance on ingredient-safety ratings, recall data, or pricing information, or loss of data, profits, or business interruption.

10. Indemnification

You agree to indemnify and hold harmless MilkNHoney from any claims, damages, or costs arising from your use of the app, your violation of these Terms, your violation of any law or third-party rights, or your reliance on app data — including ingredient-safety ratings, recall matches, and dietary-restriction, allergen, or nutrition-based diet compatibility results — for health, medical, allergy, or dietary-management decisions.

11. Changes to the app or these Terms

We may update the app or these Terms at any time. Continued use of the app after an update to these Terms constitutes acceptance of the revised Terms. Material changes (e.g. introducing paid billing) will be called out clearly.

12. Termination

You may stop using the app and delete your account at any time. We may suspend or terminate access for violations of these Terms, illegal or harmful use, or discontinuation of the service.

13. Governing law and dispute resolution

These Terms are governed by and construed in accordance with the laws of the State of Wisconsin, USA, without regard to its conflict of laws principles — regardless of the country you access the app from, since the app itself is offered internationally. Any dispute will first be pursued through good-faith negotiation between the parties; if unresolved, through binding arbitration where enforceable by law, or otherwise in the courts of Wisconsin.

14. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.
